SPEAKER: Diane Bass, Esq.

TOPIC: “Traps & Pitfalls for Attorneys to Avoid When Using Social Media”
ETHICS / SUBSTANCE. ABUSE - /BIAS CREDIT? Y (ethics)

Diane Bass is a former president of SOCBA. She is a criminal defense lawyer who specializes in Federal Criminal Defense. She has been practicing law for 20 years. Diane would like to speak to us about how social media can be used against our clients and the ethical traps and pitfalls of using social media for attorneys. Lawyers can inadvertently disclose confidential information using social media. Additionally, Rules of professional misconduct can come into play if a lawyer engages in any false or misleading statements via social media, ie: websites. This can occur if someone uses facebook to obtain information or conduct investigation about someone while using a site like facebook. Attorneys are also responsible for the conduct of non attorney assistants such as paralegals or investigators. Therefore, we have to be mindful of these potential pitfalls. We are also governed by rules about statements about judges. There are rules about trial publicity. All of these things are impacted by social media outlets like facebook, twitter, email and linkedin etc. This is a common sense talk however, it is critically important information.
